Research Paper (undergraduate) from the year 2016 in the subject Law - Public Law / Miscellaneous, grade: 16, Eduardo Mondlane University, language: Portuguese, abstract: A dimensão jurisdicional do Tribunal da SADC: alguns problemas práticos analisa o funcionamento do Tribunal da Comunidade para o Desenvolvimento da África Austral (SADC), tendo por base um estudo comparado do Protocolo que estabeleceu aquela instituição regional e o Protocolo revisto e aprovado em 2014, no Zimbabwe. Várias questões se levantam sobre os motivos que levaram a Cimeira da SADC a 'suspender' o Tribunal regional, sobre a nova dimensão jurisdicional, cujo âmbito foi conferido pelo novo Protocolo sobre o Tribunal da SADC, sobre o direito dos povos da SADC à justiça, os direitos adquiridos, a independência do judiciário, a protecção dos direitos humanos, a marcha do processo de integração regional, entre outras. Para entender a actual dimensão jurisdicional do Tribunal da SADC, serão sucintamente discutidos aspectos de natureza histórica, política, social e cultural, que estiveram na origem da criação da Conferência para a Coordenação Conferência do Desenvolvimento da África Austral (SADCC), predecessora da SADC. Esses factores que contribuíram para a criação de uma personalidade e identidade distintas da África Austral, serviram de alicerces para o estreitamento da cooperação política e económica regional ao nível da SADC, um bloco regional reconhecido internacionalmente e com instituições próprias, e que será tema do segundo capítulo. Instituído para garantir a observância e interpretação adequadas das disposições do Tratado, outros instrumentos subsidiários e deliberar sobre litígios, o Tribunal da SADC, seus poderes, competências e funções, serão igualmente objecto de análise. Tendo sido limitadas por decisão da Cimeira da SADC, em Agosto de 2014, que aprovou um novo Protocolo, as novas competências do Tribunal da Comunidade também vão ser estudadas, examinando-se as mudanças jurisdicionais e as implicações para o direito comunitário da SADC. É neste âmbito que será analisada a dimensão jurisdicional do Tribunal da SADC, estudo que será finalizado por uma conclusão e recomendações, que se espera poderem auxiliar a compreensão sobre o novo paradigma jurisdicional na região.
HERCULANO ÓSCAR FILEMÃO MOISÉS THUMBO was born in the then City of Lourenço Marques, now Maputo. He is a journalist since 1986 at Televisão de Moçambique (TVM), the public television of Mozambique, having a wide experience in communication, television, press and radio. For several years, he has been practicing urban and rural journalism, becoming profoundly aware of the reality of the population and regions of Mozambique. He has worked as a correspondent in Mozambique for foreign agencies, magazines and radios and has also reported from several countries in Europe, America, Asia and Africa. He was Director of Programs, having held various managerial and leadership positions, namely, Head of the International Desk, Deputy Editorial Director for Programs, Deputy Head of the Newsroom, Head of the Newsroom, Deputy Director of Information, Central Coordinator of the Provincial Television Centers and Coordinator of the Training Center at TVM. He holds a Master's Degree in Romanic Studies, specializing in Comparative Oral Traditions, and has a Bachelor of Modern Literature from the University of Poitiers in France. He is a university professor of Journalism, Legislation and Ethics of Communication and Notions of Law. He graduated in Law at Eduardo Mondlane University, and is currently a trainee lawyer. It is a sworn translator in Portuguese-French-Portuguese.
